A man who was convicted of two separate offences after receiving a fully suspended sentence for burglary has had 6 months of the suspended sentence of 2 years and 3 months reactivated.
Mohammed Adan Ali (33) of Lower Gardiner St. Dublin 1 appeared before the Circuit Criminal Court this afternoon where Judge Orla Crowe heard he is appealing one of the two convictions for which he received an 18th month sentence for a Section 18b theft matter.
The other conviction accrued while under the remit of his suspended sentence is a breach of Section 6 of the Public Order Act.
The Somali national also has previous convictions related to possession of a knife from the District Court.
The court heard that Ali, who is the father of four children, has “alcohol issues” but that he has a “good work history” and that he is a Safe Pass holder qualified to operate a forklift.
He also has “computer skills”, his defence counsel said.
Ali is currently in prison serving a 10 month sentence for another matter with a release date of the 3rd of December next.
In 2018 he received an 18 month prison sentence for the serious assault of another man.
Judge Crowe said that this was the second time that a Section 99 reactivation matter had come before the courts in respect of the accused and that, although the court had “stayed its hand” the first time, this would not be repeated.
The 2 year and 3 month fully suspended sentence in respect of the previous burglary had been granted on condition of “good behaviour”.
She reactivated 6 months of the suspended sentence which is to run consecutively to the sentence he is currently serving.
