As readers of the Irish Independent, or close viewers of the Seanad, discovered yesterday, a 29 year old man called David Moriarty had an uncomfortable but ultimately successful day in court in Kerry on July 4th last.
Mr. Moriarty was before the court facing an unusual charge, in Ireland: That he had “fraudulently put in a ballot box a paper other than a ballot paper you were authorised by law to put in”, which would be contrary to section 138 of the Election Act. Or in layman’s terms, that he had voted using a false identity, and by using someone else’s voting card.
