Two men who are accused of raping an imprisoning a woman in Galway city last month at Ceannt Railway station car-park, have applied to the High Court seeking bail, with one defendant saying he wanted to see his wife.
The accused men – aged 27 and 25 – appeared separately via video link at the District Court in Galway with the assistance of an Arabic interpreter.
The garda investigation file in regard to the two accused is with the Director of Public Prosecutions (DPP), the court heard.
“Each man is charged with the rape of a female on August at Ceannt Railway Station car-park, contrary to section 48 of the Offences Against The Person Act and section 2 (1) of the Criminal Law Rape Amendment Act 1981, as amended by section 21 of the Criminal Law Rape Amendment Act 1990,” Galway Live reported.
The men are also charged with falsely imprisoning the same alleged victim on the same date and at the same location, an offence contrary to section 15 of the Non Fatal Offences Against The Person Act.The 27-year-old accused man is also charged with rape, under section 4, of the same alleged victim, on August 1 at Ceannt Railway Station car-park.
That alleged offence is contrary to section 4 of the Criminal Law (Rape) Amendment Act 1990.
Both men were previously refused bail in the district court and have applied to the High Court for bail. Through the Arabic interpreter, the 25-year-old accused asked if it was possible for him to be released on bail, as he told the court he is recently married and wants to see his wife.
Judge Fiona Lydon said that there had not been any change in circumstances since bail was initially refused, and remanded each of the accused in custody for a further fortnight
