The Circuit Court has today refused to grant South Dublin County Council an interim injunction to prevent further work on the Chianti Park area in Brittas, where modular homes are being built at speed by Branach Developers despite the absence of an application for planning permission. People already living in the site are fearful for the future of their homes.
As revealed on Gript, the owners of the development site and the adjacent Chianti Park mobile home site are Keith and Richard McDermott through a company called Mullnassa Limited. The McDermotts are IPAS contractors.
South Dublin County Council had not received an application for planning permission before development of the site began or since, Cllrs Linda de Courcy and Paddy Holohan told Gript.
On Friday last, an enforcement order was issued by South Dublin County Council, and work was to stop at the site at 1.30 on Tuesday afternoon. Gript observed work continuing on the site past that point and yesterday.
Yesterday, Cllr de Courcy said that people living in Chianti Park were “very fearful” that their homes were also going to be knocked down.
This afternoon, however she said: “I have been informed by the Chief Executive of South Dublin County Council that no interim injunction has been granted which is extremely disappointing.”
She said “SDCC are meeting senior counsel later this afternoon to consider the next steps as it is hard to understand why the injunction was not granted.”
“We are also looking into how we can secure the homes of the current residents and prevent them from being knocked down,” she added.
