A “homeless” Romanian man has been ordered to stay away from Dublin Airport, where Dublin District Court heard he is “living”.
Florien Simandi (50) of no fixed abode appeared before the court charged with impeding an authorised officer in the exercise of his duty or fail to comply with directions of same contrary to Sec 48 (9) of the State Airports Act (Shannon Group) 2014 at Terminal 2 of Dublin Airport on today’s date.
He is also charged that he, on the 25th of November 2020 on Shelmalies Road, East Wall, Dublin 3, did breach Section 4 of the Public Order Act in circumstances where he was allegedly intoxicated in a public place.
The court heard that the accused is “homeless” and that he is currently “living in Dublin Airport” while he works 6-7 days a week and sends money home to his mother in Romania.
The accused said that he earns 120 per day “cash in hand” and that he sends the greater part of this to Romania, living off the balance.
Hearing the amount of earnings, Judge Patricia Cronin said that in circumstances where Simandi was earning €120 per day and working everyday, he would not be entitled to legal aid as he made it known that he is not paying rent and has no dependants.
After the accused chose to consult with a solicitor, it emerged that he may have “somewhat exaggerated” his earnings, which led the court to grant legal aid in respect of him.
Gardaí consented to bail on condition that the accused stay away from Dublin Airport unless he is actually travelling and has a valid passport and boarding pass in his possession.
He is to appear again before the Central Criminal court on the 10th of September next.
